OVERVIEW

Welcome to Marshian Cards.

Marshian Cards is a trading name of Marshian Enterprise Ltd, a private limited company registered in England and Wales.

In these Terms, the terms “Marshian Cards”, “we”, “us” and “our” refer to Marshian Enterprise Ltd trading as Marshian Cards.

We operate this website and online store, including the information, content, features, tools, products and services made available through it (the “Services”).

Our online store is powered by Shopify.

These Terms of Service, together with our Privacy Policy, Returns & Refunds Policy and Shipping Policy, set out the terms that apply when you access our website or purchase products from us.

Nothing in these Terms affects any statutory rights available to you under applicable UK consumer law.

By using our website or placing an order, you agree to these Terms.

SECTION 1 – ACCESS AND ACCOUNTS

You must provide accurate, current and complete information when placing an order or creating a customer account.

You are responsible for keeping your account login details secure and for activity carried out through your account.

You must not use our website for unlawful, fraudulent or abusive purposes.

Where a person under 18 uses our store, purchases should be made with the involvement or permission of a parent or guardian where appropriate.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, prices and other information displayed on our website are accurate.

Colours and appearance may vary slightly depending on your device or screen settings.

Product packaging may occasionally differ from photographs where manufacturers update packaging without materially changing the product.

All goods supplied to UK consumers remain subject to statutory rights. Products must be:

as described;
of satisfactory quality; and
fit for purpose where applicable.

Nothing in these Terms excludes or restricts those rights.

We may discontinue products, change our product range or impose reasonable purchase limits where necessary, including for highly allocated or limited trading-card releases.

SECTION 3 – ORDERS AND CONTRACT FORMATION

When you submit an order, you are making an offer to purchase the products in your basket.

An automated order acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and us is formed when we confirm that your order has been accepted, normally when we confirm dispatch or otherwise expressly confirm acceptance.

We may refuse or cancel an order before acceptance where, for example:

an item is unavailable;
payment cannot be authorised;
the order appears fraudulent;
there is an obvious pricing or product-information error;
we reasonably suspect an attempt to circumvent quantity limits; or
we cannot deliver to the address provided.

If we cancel an order after taking payment, we will refund the relevant amount.

You should check your order carefully before submitting it.

Your statutory cancellation and return rights are explained in our Returns & Refunds Policy.

SECTION 4 – PRICES AND PAYMENT

Prices displayed on our website are in pounds sterling (£).

The total price payable will be shown before you complete your order.

Delivery charges, where applicable, will be clearly shown before you place your order.

Marshian Enterprise Ltd is currently not VAT registered, so we do not separately charge VAT on our sales.

If our tax status changes, prices and tax treatment may be updated accordingly.

We may change prices at any time, but changes will not affect orders that we have already accepted.

Promotions and discounts may have separate terms.

You agree to provide accurate payment and billing information and confirm that you are authorised to use the payment method selected.

UK online sellers must provide customers with the total price, payment information and delivery charges before an order is placed.

SECTION 5 – SHIPPING AND DELIVERY

Marshian Cards currently delivers within the United Kingdom.

Our current shipping options, charges and estimated delivery times are set out in our Shipping Policy and displayed at checkout.

We aim to dispatch orders within the stated timeframe, but delivery dates are estimates unless we expressly state that a service is guaranteed.

We are responsible for the goods until they come into your physical possession, or the possession of a person you have identified to receive them.

We do not transfer the risk of loss to you merely because we have handed a parcel to the delivery carrier.

This replaces the Shopify template's original wording because UK consumer distance-selling rules link receipt of goods to physical possession rather than simply handing the parcel to the carrier.

Higher-value orders may be sent using an alternative tracked or insured service at our discretion.

SECTION 6 – RETURNS, CANCELLATIONS AND FAULTY GOODS

Returns and cancellations are governed by our Returns & Refunds Policy.

UK consumers purchasing online generally have the right to cancel qualifying purchases within 14 days after receiving the goods and then have a further 14 days to return them.

Separate statutory rights apply to goods that are faulty, damaged, not as described or otherwise fail to conform to the contract.

Nothing in these Terms or our Returns & Refunds Policy limits those statutory rights.

SECTION 7 – INTELLECTUAL PROPERTY

The design, branding, text, graphics and other original content created for Marshian Cards are owned by or licensed to Marshian Enterprise Ltd unless otherwise stated.

You may use our website for personal, non-commercial purposes.

You must not reproduce, distribute, modify or commercially exploit our original website content without permission, except where permitted by law.

Third-party trademarks, product names, logos, artwork and intellectual property displayed in connection with products remain the property of their respective owners.

Pokémon and related names, characters and imagery are trademarks and intellectual property of their respective rights holders.

Marshian Cards is an independent retailer and does not claim ownership of third-party intellectual property.

SECTION 8 – THIRD-PARTY TOOLS AND LINKS

Our Services may contain links to, or integrations with, services operated by third parties.

We are not responsible for the content, availability or privacy practices of third-party websites that we do not control.

Where you choose to use a third-party service, its own terms and privacy policy may also apply.

Nothing in this section excludes any responsibility that cannot legally be excluded.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Marshian Cards is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are made directly with Marshian Enterprise Ltd trading as Marshian Cards.

Shopify provides the ecommerce technology used by our store but is not the seller of the goods purchased from Marshian Cards.

Shopify's own terms and privacy policies may apply to services that Shopify provides directly.

SECTION 10 – PRIVACY

Our handling of personal information is described in our Privacy Policy.

Our store is hosted by Shopify, which processes certain information relating to your access to and use of our Services.

Please review our Privacy Policy for more information about:

the information we collect;
why we use it;
the lawful bases for processing;
who we share information with;
international transfers;
retention periods; and
your UK data-protection rights.
SECTION 11 – CUSTOMER REVIEWS AND FEEDBACK

If you voluntarily submit a review, suggestion or other feedback to us, you confirm that you have the right to provide it.

You permit us to use genuine customer reviews and feedback in connection with operating and promoting Marshian Cards.

We may moderate or remove content that is unlawful, abusive, misleading, defamatory, infringes third-party rights or otherwise breaches these Terms.

We will not knowingly alter a customer review in a way that materially misrepresents the customer's opinion.

SECTION 12 – ERRORS AND INACCURACIES

We may occasionally make typographical, pricing, stock or product-information errors.

We may correct errors on our website at any time.

If we discover a material error before accepting an order, we may cancel the order and notify you.

If payment has already been taken for an order that we cancel, we will issue a refund.

Nothing in this section permits us to remove or restrict your statutory rights after a binding contract has been formed.

SECTION 13 – PROHIBITED USES

You may not use our website:

for unlawful or fraudulent purposes;
to infringe our rights or the rights of another person;
to transmit malware or malicious code;
to interfere with the security or operation of the website;
to impersonate another person;
to collect personal information unlawfully;
to send spam or unsolicited communications;
to attempt to circumvent reasonable purchase limits or security measures; or
to scrape or systematically extract website content where doing so is unlawful or breaches these Terms.

We may restrict access to the website where reasonably necessary to protect our business, customers or systems.

SECTION 14 – AUTOMATED AGENTS

Automated or semi-automated software must not access or interact with our Services in a manner that:

circumvents security controls;
disguises automated activity as human activity;
interferes with normal operation of the store;
circumvents purchase limits; or
breaches applicable law.

We may take reasonable technical measures to restrict abusive automated access.

SECTION 15 – SUSPENSION OR TERMINATION OF ACCESS

We may suspend or terminate access to customer accounts or website functionality where reasonably necessary because of:

fraud;
unlawful activity;
misuse of the Services;
security threats; or
serious or repeated breaches of these Terms.

Termination of website access does not remove any rights or obligations relating to orders already accepted.

SECTION 16 – WARRANTIES AND STATUTORY RIGHTS

Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded.

In particular, nothing in these Terms excludes your statutory rights relating to:

goods being as described;
satisfactory quality;
fitness for purpose;
faulty goods;
refunds, repair or replacement where required by law; or
any other mandatory consumer protection.

The broad warranty disclaimer contained in Shopify's generic international template is therefore not used for UK consumer purchases.

UK businesses cannot contract out of core consumer rights relating to faulty or misdescribed goods.

SECTION 17 – LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
defective or misdescribed goods where liability cannot legally be excluded; or
breach of statutory consumer rights.

We are responsible for losses that are a foreseeable consequence of our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

If you are purchasing as a consumer, we are not responsible for business losses such as loss of profits, revenue, business opportunities or business interruption.

UK guidance specifically warns businesses against broad terms attempting to exclude responsibility for faulty goods, contractual failures, delays or personal injury.

SECTION 18 – YOUR RESPONSIBILITIES

You are responsible for providing accurate information when placing an order and for using our Services lawfully.

You may be responsible for losses we suffer as a direct result of your deliberate unlawful use of our Services or deliberate infringement of our rights.

Nothing in this section requires a consumer to compensate us for losses for which it would be unfair or unlawful to make them responsible.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary.

The remaining provisions will continue to apply.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

If we do not immediately exercise a right under these Terms, that does not mean we have waived that right.

These Terms, together with the policies referred to in them, form the agreement governing your use of our Services and purchases from us.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.

SECTION 21 – TRANSFER OF RIGHTS

You may not transfer contractual rights or obligations where doing so would materially affect our rights without our agreement.

We may transfer our rights and obligations to another organisation, for example in connection with the sale or restructuring of our business, provided this does not reduce your rights under the contract.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, nothing in these Terms deprives you of any mandatory consumer protections available under the law applicable to you.

The courts of England and Wales will have non-exclusive jurisdiction, subject to any rights UK consumers have to bring proceedings in another UK jurisdiction where applicable.

SECTION 23 – HEADINGS

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to:

our Services;
our business;
applicable law; or
our operating practices.

Any updated Terms will be published on our website with a revised “Last updated” date.

Changes will not retrospectively alter the terms governing an order that has already been accepted unless required by law or agreed with you.
